Following on from the previous bulletin regarding Intellectual Property (IP) Protection, we now look at commercialisation of IP.
Commonly commercialisation of IP can take the form of licensing the IP rights you have developed, but there are other ways.
A classic example of commercialisation of IP is the franchise system which generally involves the granting of rights to use branding, business methodology and IP.
You may have a great methodology or artistic creation. In Australia we are lucky to have wonderful indigenous art. It is critical that the owners of rights in IP take care to protect those rights at the same time as any commercialisation of it occurs. In some cases simply discussing your idea with someone can cause a loss of some protections.
Frequently people will take out trademarks, patents, registered designs and like to protect their IP before commencing commercialisation. Copyright exists in music, artwork and written word (and some other things).
If you are commercialising IP then you must obtain legal advice from the outset.
